DEFINITIONS

For the purposes of this DPA, the following terms have the following meanings

  • "Adequate Country" means, as applicable (i) in relation to the EEA, a country outside the EEA designated as a country deemed to afford an adequate level of protection by the European Commission in accordance with Article 45 of the GDPR. For the purposes of this DPA, "EEA" means the Member States of the European Union, as well as Iceland, Liechtenstein and Norway; and (ii) in respect of the United Kingdom and/or Switzerland, a third country outside the United Kingdom or Switzerland (as applicable) which offers an adequate level of data protection pursuant to an adequacy decision published by the competent data protection authority

  • “Data Protection Laws” means all privacy and data protection laws and regulations applicable to the processing of individuals' personal data under this DPA in connection with the Wix Services, including European Union Regulation 2016/679 (the "GDPR") and the national law of the applicable EEA Member State implementing the GDPR and California Civil Code Section 1798.100-1798.199 (the "CCPA"), the UK General Data Protection Regulation (the " UK GDPR") (as applicable) and any law or regulation ratifying, implementing, adopting or supplementing such law; in any case, to the extent they are in effect, and as such are updated, modified or replaced from time to time.

  • "Interested" means the identified or identifiable person to whom the Personal Data refers.

  • The terms 'Controller', 'Personal Data', 'Personal Data Breach', 'Processing' and 'Processor', as used in these DPAs, shall have the meaning given to them in the GDPR and shall be understood to include any term other than but similar used in any other data protection law.

  • “Jurisdiction-Specific Terms” means the terms and conditions that apply to Users who are subject to certain additional jurisdiction-specific data protection laws, as specified in Schedule 1 to this DPA.

  • "Model Contractual Clauses" or Standard Clauses means the EU Model Contractual Clauses approved by the European Commission Implementing Decision (EU) 2021/914 of 4 June 2021 on standard contractual clauses for the transfer of personal data to third countries in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (available at https://eur-lex.europa.eu/eli/dec_impl/2021/914/oj?uri=CELEX:32021D0914&locale=en ) (in each case, as applicable, taking into account the nature and roles of the data exporter and data importer).

  • “User User Information” means User User Personal Data (as defined in the Privacy Policy) that you submit to WIX or that may otherwise be processed by WIX on your behalf.

  • "WIX Security Documentation" means the technical and organizational measures that WIX implements and maintains to protect users' information, as detailed in Overview of WIX security measures  (or as otherwise made reasonably available by WIX), all as may be updated from time to time.

PROCESSING METHODS: The processing of personal data of the interested party is carried out by means of the operations indicated in article 4, paragraph 2 of the GDPR, such as for example the collection, registration and conservation, carried out with or without the aid of Informatic Systems. In any case, the logical and physical security of the data and in general the confidentiality of the personal data processed will be guaranteed, implementing all the necessary technical and organizational measures to guarantee their security.

  26. Processing by Wix. When Wix processes User Information on your behalf in the course of providing the Service, Wix will: Process User Information only for the following purposes: (i) to provide the Services to you in accordance with the Agreement and this DPA (including any applicable Jurisdiction Specific Terms), (ii) in accordance with reasonable documented instructions contained in in this DPA and as subsequently requested by you, to the extent your instructions are consistent with the Services and this DPA; and (iii) as required by laws applicable to Wix or subject to the requirement of a competent authority, provided that if Wix is required by law to process your information for any other purpose, Wix will provide you notice of such requirement, unless Wix is prohibited by law from providing such notice.

  27. The Kite Ensures that Wix's submission of Personal Data, Wix's handling of User Information, and Wix's handling of User Information when using the Services comply with Data Protection Laws. Establish and have all necessary consents, legal bases and permissions to collect, use and otherwise process and transfer User Information to Wix and to authorize the Processing by Wix and for Wix's processing activities on behalf of the user, including the pursuit of "business purposes" as defined under the CCPA. Have sole responsibility for the accuracy, quality and legality of user information and the means by which it was obtained. Be solely responsible for any transfer of User Information by you (or any other person acting on your behalf) to any platform other than Wix or any other third party.
